Terms & Conditions of Use & Messaging Terms

These Terms & Conditions (“Terms”) govern your access to and use of the services, website, mobile app, and messaging (SMS/MMS) communications offered by Relentless Real Estate (“we,” “us,” “our”). By using or accessing our services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use or access our services.


1. Definitions

Service(s): Our real estate services, website(s), mobile applications, tools, content, SMS / messaging, and other functionalities provided by Relentless Real Estate.

User / You: Any person or entity using or accessing our Services.

Customer: A user who has engaged us for real estate services (e.g. property buying, selling, brokerage services, lead services).

Content: All text, images, video, data, files, documents, software, graphics, and other materials provided via the Services.

Messaging / SMS / MMS: Any application-to-person (A2P) messages sent by us (or our service providers) to your phone number as part of our communications (marketing, updates, alerts).

Campaign / Program: Our SMS / messaging program under which messages are sent to users.

Opt-In / Consent: Your express affirmative agreement to receive messages from us via SMS/MMS.

STOP / HELP commands: Standard keywords you can text to manage your subscription (e.g. stop messages, get help).


2. Application & Acceptance of Terms

These Terms apply to all users of the Services, whether browsers, visitors, registered users, or paying customers.

By using or accessing the Services, you accept and agree to these Terms (and any updates).

Where a separate agreement exists (e.g. a real estate services agreement, listing agreement, buyer agreement), these Terms are supplemental, unless the separate agreement expressly supersedes them.


3. Real Estate Services Terms

Because we operate as a real estate business, some additional provisions apply:

3.1 No Guarantee of Listings or Deals

We may provide property listings, market information, valuations, lead generation, referrals, marketing, consultation, and related real estate services. However, we do not guarantee that every user will successfully buy or sell a property, obtain financing, or close a deal. All real estate transactions carry risk, and results depend on external factors (market, financing, inspections, seller, buyer).

3.2 No Legal, Tax, or Financial Advice

Nothing on our website, app, messages, or communications constitutes legal, tax, financial, or investment advice. Always consult qualified professionals (attorneys, accountants, mortgage advisors) before acting on any information.

3.3 Client Relationship

If you become a client, you may sign a separate contract (buyer’s agreement, listing agreement, etc.). That contract governs duties, commission, exclusivity, obligations, etc.

You must provide accurate, truthful, complete information regarding your property, financial circumstances, and identity.

You hereby authorize us to represent you, contact third parties, advertise your property, perform due diligence, etc., as needed under applicable laws and regulations.

You agree to indemnify and hold us harmless from claims arising due to your misrepresentations, omissions, or breach of the agreement or these Terms.

3.4 Licensing and Compliance

We comply with all applicable federal, state, and local real estate laws, licensing rules, disclosure requirements, and fair housing laws. You may be required to sign disclosures, permits, or authorizations as needed.


4. Messaging / SMS / A2P Terms

Because we utilize SMS / MMS (A2P) messaging as part of our communications (e.g. appointment reminders, lead alerts, promotions), additional rules apply:

4.1 Consent / Opt-In Required

We will only send you messages if you have given us prior express consent (opt-in). You acknowledge that consenting to receive messages is voluntary and not required to access our Services (unless agreed otherwise).
We may ask you to confirm consent (double opt-in).

4.2 Content of Messages / Message Types

Messages may include, but are not limited to:

Real estate updates, property alerts, listing information

Appointment reminders, status updates, notices

Promotional offers, marketing communications

Surveys, polls, feedback requests

We will make reasonable efforts to ensure message content is accurate, relevant, and lawful.

4.3 Frequency / Cost Disclosure

Message frequency may vary.

Message & data rates may apply depending on your carrier plan.

You are responsible for any fees charged by your carrier.

4.4 STOP / HELP Instructions

You may reply with “STOP” to opt out of receiving further messages. After receiving a valid STOP request, we will cease messaging you (except service messages) within a reasonable time.
You may reply with “HELP” for assistance or further instructions.

4.5 Support / Contact Info

We will provide a contact method (email or phone) for support or assistance regarding the messaging program.

4.6 Compliance with Laws

5. User Obligations & Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of any applicable law or regulation

Post, transmit, or distribute content that is fraudulent, defamatory, obscene, harassing, infringing, or violates third-party rights

Use automated means (bots, scrapers, spiders) to access or collect data from our Services

Interfere with or disrupt the Services, servers, or networks connected to the Services

Attempt to circumvent any security mechanism or feature

Impersonate another person or misrepresent your affiliation

We reserve the right to suspend or terminate accounts or access for violations.


6. Intellectual Property

All rights, title, and interest in and to the Services, software, content, design, trademarks, logos, and branding are owned by us or our licensors.

You may view, download (for caching), and print pages for personal, noncommercial use only.

Except as expressly permitted, you must not copy, reproduce, distribute, republish, display, sell, license, or create derivative works of our content.

If you upload or submit content (e.g. feedback, photos), you grant us a worldwide, nonexclusive, royalty-free, perpetual license to use, distribute, modify, adapt, publicly display, and incorporate into our Services.


7. Disclaimers & Limitation of Liability

7.1 Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, noninfringement.

We do not guarantee uninterrupted access, error-free performance, or accuracy of content.

We are not liable for third-party content, links, or services accessible through our Services.

7.2 Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, data loss, or business interruption) arising from your use or inability to use the Services, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from or relating to these Terms or the Services shall not exceed the amount you paid (if any) during the 12 months preceding the claim (or a small fixed cap, e.g. $100).

Some jurisdictions do not allow disclaimers or limitations of certain types of liability; if such provisions are unenforceable, liability will be limited to the fullest permissible under applicable law.


8. Indemnification

You agree to indemnify, defend, and hold harmless Relentless Real Estate, its affiliates, officers, directors, employees, agents, licensors, and partners from any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from or related to:

Your breach of these Terms

Your misuse of the Services

Your violation of applicable laws or third-party rights

Real estate actions you take based on our Services or advice


9. Termination; Suspension

We may suspend or terminate your access to the Services at any time for cause (violation of Terms, fraud, abuse).

You may terminate by ceasing use; certain provisions (intellectual property, liability, indemnity) survive termination.

Termination does not relieve you of accrued obligations or liabilities.

If messaging (SMS) is terminated, we will cease sending messages (except required confirmations or notices) after a reasonable period.


10. Changes to Terms

We may update or modify these Terms at any time. We will post changes on our website or app with a “last updated” date.

Significant changes (material changes) may be communicated (via email or notice).

Continued use of Services after changes constitutes acceptance of the revised Terms.


11. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Your State, e.g. Massachusetts or your principal place of business], without regard to conflict of laws.

Any dispute arising out of or relating to these Terms, the Services, or your use thereof shall be resolved through binding arbitration [or in courts, depending on your choice].

14. Miscellaneous

You may not assign or transfer your rights under these Terms without our written consent; we may freely assign.

These Terms, along with the Privacy Policy and any separate real estate or messaging agreement, form the entire agreement between you and Relentless Real Estate.
